Demolition of a home and a barracks in Anattah / occupied Jerusalem

September 5, 2018, Israeli military forces demolished a home and an agricultural barracks in "Al-Fhedat quarter" Anatah about 50 meters away from the Apartheid wall on the pretext of building without permission, The house belongs to Saleh Al-Fhidat, it consists of one floor with an area of 180 m2, and inhabited by 6 members, 3 of them are children (under 18).

Saleh Al-Fhidat told LRC observer:

"number of Israeli military forces broke into the quarter and asked us to clear out the house before the occupation bulldozers completely destroyed it"

 Then they demolished a barracks used for animal husbandry and owned by villager Wajeha Abdul-Jawad who works in raising chicken and ducks , The barracks has an area of 80 m2 and lies about 100 meters from the apartheid wall.

"Israeli civil administration" broke into the area in august 3 2017, and distributed about 23 demolition orders to houses and barracks on the pretext of building without permissions.  It is noteworthy to mention that most of the houses were built before Israel occupied Jerusalem in 1967.

Al-Fhidat quarter / Anattah  lies about tens of meters away from (Anatot) military camp (a location used for training soldiers). The Israeli occupation is aiming to take over the whole quarter in order to use it for the same purpose, the quarter is surrounded by an apartheid wall, and contains the least of life possibilities, families in the quarter get water and electricity from Anatah town, children suffer on their way to school as the closest school is 2 km away.

About 10 km north east Jerusalem, Anatah is surrounded by Hizma (north), Shufat (west) , Al'Eizariya and Jericho (east) Al'Isawiya (south).  Anatah has a population of (16,919) people  in 2017 census. The Israeli illegal occupation confiscated about (5727) dunums for the following purposes:

  • Bypass roads (1 , 437 , 485)  confiscated (1,301) dunums.
  • The apartheid wall took over (341) dunums , and isolated (506) dunums , and in case it was completed according to the revealed plan it will isolate (16 ,026)dunums.
  • Military camps confiscated (1,317) dunums.

According to Oslo convention the land is divided to 2 parts:

Area B : (902) dunums.

Area C: (23,124) dunums.

Legal feed back :

 The doings of the occupation's authorities of demolishing Palestinian homes and buildings is a serious violation of international and humanitarian law. And violate the rights of Palestinian citizens as ensured by international law and international conventions which is the right of an appropriate residence . According to the following articles:

Article 147 of Geneva fourth convention  : extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly. ( it is considered a serious violation of the convention)

Article 53 of Geneva fourth convention that forbids destroying properties : Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or co-operative organizations, is prohibited, except where such destruction is rendered absolutely necessary by military operations.

Article 33 of Geneva fourth convention: No protected person may be punished for an offence he or she has not personally committed.

Article 32 of Hague convention 1907 part g: To destroy or seize the enemy's property, unless such destruction or seizure be imperatively demanded by the necessities of war.

Article 17 of Universal declaration of human rights 10 –Dec- 1948:  No one shall be arbitrarily deprived of his property.
