Violation: Demolishing residential and agricultural facilities.
Location: Ras Al-‘Auja and Fasayil Al-Wousta – Jericho governorate.
Date: August 25th 2020.
Victims: Citizens from Nawawra family.
Description:
The Israeli Occupation authorities accompanied by the building and organization officer raided Fasayil Al-Wousta north Jericho and carried on demolishing several residential and agricultural facilities for families living close to bypass 90.

Affected Citizen Imad Nawawra (37) told LRC:
“We have been living in Fasayil Al-Wousta for more than -16 years- during which we suffered several times from the occupation’s arbitrary policies. The first time was in 2007, the occupation authorities demolished all our facilities, lately in August 2019, we received a halt of work notice and a “Notice to stop assaulting an archeological site”, we followed the case in the Israeli courts with the help of Legal Department in Jericho governorate, but the occupation refused to provide us with licenses, and demolished our facilities.”
Fasayil is 23 km north of Jericho and its built-up area is 147 dunums only ( Fasayil village council). This area does not meet the natural increase of population. More than 30 residences and barracks were demolished as a result. It has a population of 1132 (according to Palestinian Central Bureau of Statistics in 2010). It is surrounded by a number of illegal Israeli colonies that limit the expansion of the village and deprive its inhabitants from having a normal life.
From the north, Fasayil is surrounded by colonies of Yafit and Pezael (Fezael), Tomer and Gilgal and Netiv Hagedud from the south in addition to a bypass that links the northern colonies with the southern ones.

Confiscating a residence in Ras Al-Auja:
It is reported that the Israeli Occupation forces dismantled and confiscated the components of a residence in Ras Al-Auja northwest Jericho , the targeted residence belongs to Jaber Rasheed from the community and has a total area of 72 m2.
Owner Jaber Said (19) told LRC:
“6 months ago I built a small residence to start a family with my bride to be, as we were supposed to get married this year. Without receiving any halt of work or demolition notices, I was suddenly shocked by the occupation bulldozers demolishing and confiscating my residence on the pretext of building in a state property.”
Early this year, the occupation authorities demolished about 18 residential and agricultural facilities in Ras Al-Auja.

Legal Feedback
Demolishing houses and facilities is a violation of international conventions and agreements , and a violation of Palestinians basic rights:
Article 147 of Geneva fourth convention: extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly. ( it is considered a serious violation of the convention)
Article 53 of Geneva fourth convention that forbids destroying properties: Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or co-operative organizations, is prohibited, except where such destruction is rendered absolutely necessary by military operations.
Article 33 of Geneva fourth convention: No protected person may be punished for an offence he or she has not personally committed.
Article 32 of Hague convention 1907 part g: To destroy or seize the enemy's property, unless such destruction or seizure be imperatively demanded by the necessities of war.
Article 17 of Universal declaration of human rights 10 –Dec- 1948: No one shall be arbitrarily deprived of his property.
