IOF demolish an agricultural room in Qusra village/ Nablus governorate

Violation: Demolishing an agricultural room.

Location: Qusra village/ Bethlehem governorate.

Date: 18/06/2019.

Perpetrator: The Israeli occupation army.

Victims: Musa Hassan.

Description:

Tuesday,   a massive army force raided Qusra village in Nablus governorate, and demolished an agricultural room that belongs to Musa Hassan (71) which has an area of 42 m2, and provides a sub-side source of income for his family of 8.

Musa Hassan told LRC reporter:

“The occupation forces demolished the room in “She’ab Al-Kharab” without any warnings, on the pretext of building in C area without licenses.

This is the second time the occupation authorities demolish a structure in my land, the first one was in 12 November 2018, but this time they also confiscated its components. In addition to that , 3 trees were sabotaged during the demolition operation.”

Noteworthy, Farmer Hassan owns a 5 dunums plot , of which 4.5 dunums are planted with olive trees, and the rest contain a variety of crops, it also contain a 42 m2 plot, that Hassan rests in during cultivation days, but unfortunately, the land is continuously targeted by Israeli assaults.

Qusra:

23 kilometer south of Nablus, Qusra is surrounded by Jurish (North) , Talfit (West), Majdel Bani Fadel (east) and bordered by “Mitzpe Rahel” (south).

 Qusra has a population of 5318 people according to projections made in 2017. It has a total area of 8886 dunums, 775 of which are a built-up area of the village.

The Israeli occupation devoured 223 dunums of Qusra lands, for the following purposes:

“Megdalim” settlement was established in 1984 devoured 155 , and inhabited by 348 settlers according to 2018 census.

Bypass roads (508) devourd 68 dunums.

International Conventions and agreements pertaining to house and residents demolition:

  • Article 147 of Geneva fourth convention  : extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly. ( it is considered a serious violation of the convention)
  • Article 53 of Geneva fourth convention that forbids destroying properties : Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or co-operative organizations, is prohibited, except where such destruction is rendered absolutely necessary by military operations.
  • Article 33 of Geneva fourth convention: No protected person may be punished for an offence he or she has not personally committed.
  • Article 32 of Hague convention 1907 part g: To destroy or seize the enemy's property, unless such destruction or seizure be imperatively demanded by the necessities of war.
  • Article 17 of Universal declaration of human rights 10 –Dec- 1948:  No one shall be arbitrarily deprived of his property.
