Violation: Establishing the first colonial quarter in “Amihai” settlement.

Location: Jalud – Nablus governorate.

Perpetrator: The Israeli occupation settlement’s council.

Victim(S): Farmers of Jalud and Tumus’ayya.

Description:

Field observation shows that the Israeli occupation are ravaging and leveling about 60 dunums of agricultural lands.

The agricultural lands were confiscated from Palestinian farmers under claims that they are an “Israeli state’s property” and now being used for colonial expansion.

40 ready-to-use residential units , paved roads , Electricity network were installed to guarantee the development of the new colonial quarter.

The new quarter is only a part of a built-up colonial plan ratified by the so called building and organizing committee of the Israeli occupation Civil Administration.

Noteworthy, In June 19 , the Israeli ministry of finance announced built up scheme (1/252) to establish a new settlement “Amihai” on lands from Jalud town (Nablus governorate) and Turmus’ayya (Ramallah governorate), the plan will devour 205.3 dunums of Palestinian agricultural lands to build 102 residential units.

The Israeli Supreme Court rejected petitions of the Palestinian affected farmer.

The new settlement will connect “Adei Ad” and “Shvut Rahel”, this is only a part of an Israeli grand scheme that aims to connect “Adei Ad”, “Shvut Rahel”, “Eli” , “Shilo” and “Maale Levona” to create a colonial city in the heart of west bank, this project will devour thousands of agricultural dunums.

About Jalud:

Jalud is located 29km to the southeast of Nablus city and is edged by Qusra village from the northeast, Qaryut village from the west, Yesh Kodish and Ahya outposts from the east and Shilo colony from the south.

Its population mounts up to 598 people (2014 census). Jalud's total land area is 22,473 dunums, of 80 dunums are considered the village's built-up area.

Israeli colonies confiscated 2227 dunums from Jalud lands. Shilo colony that was established in 1978 confiscated 640 dunums from the village. Mizpe Rahel colony and other outposts namely (Yesh Kodish, Ahya, Eli, Adi Ad and Kida) are founded on confiscated lands from the village.

Bypass roads confiscated around 436 dunums from the village.

The lands of Marda are classified according to Oslo Accords as the following:

  • 5541 dunums (25%) are classified as area B
  • 16932 dunums (75%) are classified as area C

Land Research Center sees Israel continuous expansion on colonies in the West Bank and Jerusalem at the expense of Palestinian and lands a flagrant violation of Human Rights and all international laws and conventions, which prohibit disposition of public properties in occupied countries.

  • Security council resolution 242 year 1967:   Withdrawal of Israel armed forces from territories occupied in the recent conflict; and  Termination of all claims or states of belligerency and respect for and acknowledgement of the sovereignty, territoial integrity and political independence of every State in the area and their right to live in peace within secure and recognized boundaries free from threats or acts of force.

  • Security council resolution 446 year 1979:   Determines that the policy and practices of Israel in establishing settlements in the Palestinian and other Arab territories occupied since 1967 have no legal validity and constitute a serious obstruction to achieving a comprehensive, just and lasting peace in the Middle East;

  • Security council resolution   452 year 1979: the resolution once again denounced Israel's settlement activities in territories occupied in 1976 including (East) Jerusalem, this activity constituting a violation of the Fourth Geneva convention, and called on Israel to cease planning and construction of settlements

  • Security council resolution 465 year 1980: calls to dismantle the existing settlements and in particular to cease, on an urgent basis, the establishment, construction and planning of settlements in the Arab territories occupied since 1967, including Jerusalem; Calls upon all States not to provide Israel with any assistance to be used specifically in connexion with settlements in the occupied territories;

  • Security council resolution 478 year 1980:  Censures in the strongest terms the enactment by Israel of the "basic law" on Jerusalem and the refusal to comply with relevant Security Council resolutions, Those States that have established diplomatic missions at Jerusalem to withdraw such missions from the Holy City.
