Violation: Demolition of a house on the pretext of building without a license.

Location: As-Sateeh area / Jericho governorate.

Date: January 27th 2022.

Perpetrators: The building inspector at the Israeli civil administration.

Victims: Citizen Ahmed Thalam.

Description:

Thursday, January 27th 2022, the building inspector at the Israeli civil administration raided As-Sateeh neighborhood, and targeted an under construction house belongs to citizen Ahmed Thalam, on the pretext of building without a license.

The targeted house composes of one floor with a total area of 80 m2 , built of bricks and concrete , and was supposed to be a home for the affected family (7 members, among them 5 children and 3 females).

The Israeli Occupation targeted the structure on Tuesday , October 26th 2021 , with a military order number (851) , which orders the immediate stoppage of construction on the pretext of violating as antiquities area, for more information read LRC report at the time “Arabic , English”.

During December , the occupation demolished two under construction houses in As-Sateeh area , on the pretext of building without a license.

In the past years, the occupation targeted 24 houses and facilities with halt of work notices on the pretext of building without a license in As-Sateeh , in addition to demolishing 9 houses during the past five years.

As-Sateeh in lines:

As-Sateeh is related to Jericho governorate administratively related to Jericho governorate, northeast the city , and has a population of 940 people according to Jerusalem municipality , most of which originate from Jerusalem and Hebron , and the rest belong to three families : (Samrat, Fhidat , Jama’an) and they originate from Jericho.

 As-Sateeh has a total area of 2300 dunums, and consists several religious and historical sites, which makes it a destination for tourists.

The demolition of Palestinian homes and structures by the occupation authorities is part of their violations of international and humanitarian law, and the violation of the right to adequate housing for Palestinian citizens guaranteed by international law and international treaties presented by the following articles:

The Fourth Geneva Convention, Article 147, stipulates that “extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly” is a “grave breach” of the Convention.

Article 53 of the Fourth Geneva Convention of 1948 prohibits the destruction of property, as this article states the following: “The occupying power is prohibited from destroying any private, fixed or movable property related to individuals or groups, the state or public authorities, or social or cooperative organizations, unless the war operations inevitably require this destruction.
