Demolishing a house and dislocating its residents in Khirbet al Marajim / Nablus

Early on Thursday,18 October 2018, Israeli military forces broke into Khirbet al Marajim , south west Duma village in Nablus governorate. The occupation bulldozers demolished citizen's Musallam Ma'arouf Musallam (60 years)home which has a total area of 65 m2, and inhabited by 6 members, and it is a residential barracks.

Nasim Mohammad Musallam, an activist in the area and a monitor of Israeli violations told LRC observer:

(In the early hours of Thursday morning 18 October 2018, Israeli military forces and their bulldozers broke into Khirbet al Marajim and carried out demolishing citizen's Musallam's home on the pretext of building without permission in area ( C) , this is the second time the house is demolished during the last three months, The occupation is pursuing people of Khirbet al Marajim to demolish their homes and continue threatening to demolish their p on the pretext of building without permissions, but in reality, the real aim is to keep the area a colonial stock to use whenever they need to)

Khirbet al Marajim:[1]

Khirbet al Marajim lies 4 km east of Duma village. Its land lies between two mountains belonging to the village of Talfit south of Nablus. The total area of the village is about 13 thousand dunums, while the number of inhabitants does not exceed 60 people who depend on the agricultural sector and sheep raising for living.

Like other Bedouin ruins in the southern countryside of Nablus, the Khirbet  al Mergim is a target of the Israeli occupation that is trying to kick Palestinians out and take over Most structures in the Khirbet, the simple houses made of bricks or tin, are threatened with demolition or stop-work orders. Only with the steadfastness of its people that the Khirbet is managing to still exist until today.

Legal feedback:

The doings of the occupation's authorities of demolishing Palestinian homes and buildings is a serious violation of international and humanitarian law. And violate the rights of Palestinian citizens as ensured by international law and international conventions which is the right of an appropriate residence . According to the following articles:

Article 147 of Geneva fourth convention  : extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly. ( it is considered a serious violation of the convention)

Article 53 of Geneva fourth convention that forbids destroying properties : Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or co-operative organizations, is prohibited, except where such destruction is rendered absolutely necessary by military operations.

Article 33 of Geneva fourth convention: No protected person may be punished for an offence he or she has not personally committed.

Article 32 of Hague convention 1907 part g: To destroy or seize the enemy's property, unless such destruction or seizure be imperatively demanded by the necessities of war.

Article 17 of Universal declaration of human rights 10 –Dec- 1948:  No one shall be arbitrarily deprived of his property.
