The Occupation Order for Eviction to 73 Dunams in Duma Village/ South Nablus

Violation: Issued 15 orders targeted planted lands with 765 olive trees and saplings.

Location: Duma village, south Nablus.

Date: February, 19th 2025.

Perpetrator: The so- called Israeli Civil Administration.

Affected party: Several farmers from the village.

Details:

Wednesday morning, February,19th 2025, Duma village located south Nablus raided by government property inspector followed by the Israeli civil administration, the occupation began to distribution and publishing several military notices with maps and aerial photo.

The occupation authorities order for eviction about 73.5 dunams from the lands of the village, classified as ‘’state lands’’, giving citizens 45 days to carried out the eviction order and return the land to it’s previous state.

The occupation targeted two locations:

  • The eastern area from the village: Marah Al Foul location, Al Shajra, Al Shaqara.
  • The southwest area: Ras Al Aqra’ location, Al Juhina, Al Mashani.

The lands were targeted located just a few meters away from village’s homes. During over past months, there were rehabilitated and retaining walls in addition to planted with olive saplings and trees with aim to protect it from settlers’ practices, previously these plots planted with wheat.

Mr. Suliman Dawabsheh, a head of Duma village council told as follows:

‘’the targeted lands had previously attacked by settlers. Settlers from nearby outpost from the village from eastern part try to transferring these plots into pastures to them, and trying to access, so the Israeli occupation’s actions are steps to stealing lands.

The lands that the occupation targeted with notices 

Duma village:

The total area of Duma is about 18,318 dunams, of which 376 dunams are built-up area.

It is bordered by Fasayil to the east, Qaryut and Qusra to the west, Majdal Bani Fadil to the north, and Al-Mughayyir to the south.

Bypass road number (458) passes through the village lands with a length of 3,360 m and confiscates about 336 dunams under its path. The occupation controls about 130 dunams as camps for the Israeli army.

According to the Oslo Agreement, 95% of the village lands are classified as Area C, meaning they are under complete Israeli control.

  • Area B: 919 dunams.
  • Area C: 17,399 dunams.

Land Confiscation Violates International Laws:

What Israel is doing in the occupied Palestinian territories is considered a violation of the Palestinian people's rights and their lands, and a violation of international laws and conventions. The following are the most important texts contained in international laws and treaties that prohibit Israeli settlement in Palestinian territories and prevent interference with civil and public rights and properties in occupied territories, along with relevant United Nations resolutions.

Lahay Convention / 1907:

  • Article 46: The occupying power may not confiscate private property.
  • Article 55: The occupying power is considered a manager of lands in the occupied country and must treat the country's properties as private property.
  • Fourth Geneva Convention / 1949:
  • Article 49: The occupying power has no right to transfer its citizens to territories it has occupied, or to take any action that leads to demographic change in them.
  • Article 53: The occupying forces have no right to destroy individual or collective personal property, or property belonging to individuals, the state, or any authority in the occupied country.
  • Article 147: The destruction and appropriation of property not justified by military necessity and carried out on a large scale in an unlawful and arbitrary manner is a grave breach.
